The magistrates’ court issues criminal fines and some types of parking fines. The court orders you to pay either immediately or in instalments and there can be serious consequences if you do not pay.

If can not afford to pay the instalments to a fine, you must tell the court and ask for a reduction. They are likely to ask for details of your financial situation, for example your income and spending.

If a fine is not paid, the court will issue a collection order. If you default on a collection order, the court can:

  • Issue a distress warrant and use of private bailiffs
  • Deduct payment from your wages or benefits
  • Clamp your vehicle and sell it if the fine is not paid
  • Apply for a charging order using the county court
  • Send you to prison
  • Give you a short detention in a police or court cell
  • Make you to do unpaid work in the community

Magistrates’ courts also issue liability orders for council tax arrears and child support arrears.

The consequences of not paying fines can be very serious, so it is important you get correct advice. If there is any threat of imprisonment you may need specialised legal help from a solicitor.

If you do not have access to a solicitor, there are places you can go for free advice on magistrates’ court fines.

Law centres are based in many larger towns and offer free advice from qualified solicitors or barristers. The Law Centres Federation can help you find one.

Fines issued in relation to criminal offences are not recorded on your credit file.

Details of defaulted fines in England and Wales are kept by Registry Trust and for a fee of £8 can be searched by anyone, including creditors.
